Terms of Service

Last updated: DRAFT, to be reviewed before launch

1About these terms

These terms are an agreement between you and Plannook ("we", "us") for your use of the NoCap app and website ("NoCap"). By creating an account or using NoCap you agree to them. If you do not agree, please do not use NoCap.

2Who can use NoCap

NoCap is for everyone, of any age, who wants to keep track of their spending. We encourage young people to use it too, so they can build good money habits early.

If you are under 18, or under the age of majority where you live, a parent or legal guardian must read and agree to these terms on your behalf before you use NoCap, and they are responsible for your use of it. If you are under 13, a parent or guardian should set up the account for you and help you use it.

You are responsible for keeping your login details safe and for everything done through your account.

3What NoCap is, and is not

NoCap helps you record and understand your own money: accounts, spending, income, cards, cashback and bills. It is a record-keeping tool.

  • NoCap is not a bank, an e-wallet or a payment service. It does not hold or move your money.
  • NoCap does not give financial, tax, legal or investment advice. Suggestions such as which card to use, tips to improve survival months, and comparisons with other users are general information only.
  • Figures are calculated from what you enter. Cashback amounts are estimates based on the rules you set up and may differ from what your card issuer pays. Always check your bank and card statements before relying on any number.

4Shared books

You can invite other people to a shared book. Everyone in a shared book can see and change its accounts and records. You are responsible for who you invite and for having permission to record information about other people, such as the people you split bills with. If you invite your child, make a separate book for them, so they see only that book and not your own records.

5Your content

The records you enter remain yours. You give us permission to store, process and display them only so that we can run NoCap for you and the people you share books with, as described in our Privacy Policy. You must not enter anything unlawful or that you have no right to record.

6Acceptable use

You agree not to:

  • break the law or use NoCap for fraud, money laundering or other illegal purposes;
  • try to access other people's accounts or data, or to get around our security;
  • interfere with, overload or reverse engineer the service, except where the law allows;
  • use NoCap to harass or harm anyone.

We may suspend or close accounts that break these rules.

7Premium plan and payments

Some features may need a paid subscription. Prices are shown in the app before you buy and may differ by country. Subscriptions are sold and billed through the Apple App Store or Google Play, renew automatically until cancelled in your store account settings, and are covered by that store's refund rules. If you are under 18, ask your parent or guardian before buying a subscription. A subscription bought by one member lets more people join that member's shared books, up to the number the plan allows, and may unlock premium features for the other members inside those books, as described in the app.

8Availability and changes

We work to keep NoCap available and your data safe, but we cannot promise it will always be uninterrupted or error-free, especially during beta. We may change, add or remove features. If we stop offering NoCap, we will give you reasonable notice and a way to export your data.

9Liability

Nothing in these terms limits rights you have under consumer law that cannot be excluded, including under the Consumer Protection Act 1999 (Malaysia), the Consumer Protection (Fair Trading) Act 2003 (Singapore) and the Australian Consumer Law.

To the extent the law allows, NoCap is provided as is, and we are not liable for losses that come from relying on figures in the app, from decisions you make about your money, or from things outside our reasonable control. Where our liability cannot be excluded, it is limited to the amount you paid us in the 12 months before the claim, or to supplying the service again.

10Ending your use

You can stop using NoCap and delete your account at any time in Settings. We may suspend or end your access if you seriously or repeatedly break these terms, and will tell you why unless the law prevents us.

11Changes to these terms

We may update these terms. If a change is significant, we will tell you in the app or by email before it takes effect. If you keep using NoCap after that, the new terms apply.

12Governing law

These terms are governed by the laws of Malaysia. If you live in Singapore or Australia, you also keep the protection of the mandatory laws of your country, and you may bring a claim in the courts where you live.
